FLR(M)

Post by phonique » Tue Nov 17, 2015 7:31 pm

Hello

Need a little advice. I can't find exact details since our circumstances and application is circumstantial.

Myself and my soon to be wife will be getting married in December and intend to apply for a spouse visa. We are both over the age of 18

I in receipt of Carer's allowance and therefore must meet adequate maintenance. I also study part time.

I myself receive in total per month this;
£422 Student funds.
£62 Carer's allowance.

I'm exempt from Council tax, I have suitable accommodation for us both and the rent is £130 per week.

My girlfriend is currently on a Student visa with a 20hour work limit.
She works as a translator and the hours vary from 5 per week to 2 per week. However she would of only held this job for 2 months prior to the date we will make our application. Therefore can we use the income towards the adequate maintenance?

She owns property in China(Name on the deeds) and is in receipt of rent from the property and she has a written contract of the amount that is paid to her. The contract is in writing and it's not an official document but it specifies the amount paid each week. Is this acceptable as proof?

My girlfriend has savings of 5000 at most but over the months it varies(as she uses to buy) however she is financially supported from parents who regularly transfer her money to the account so it always stays topped up, it has on a few occasions ran down to under £100 before it was topped up again.

In addition to this she has a Chinese visa card in her name, from her home country. I can't find any information on this in the guidance if it can be used. It allows her to spend money that is officially owned by her parents but with limit of 2000 per month. Is this usable at all?

Hey. I can imagine I made my question quite complicated.

Maybe I can rephrase somewhat and ask another question

My partner owns property. She has a written agreement with the tenants of her property. The schedule for payments is very flexible. Therefore payments are not made into her accounts every week or month. Rather payments are every three or two months. The tenants even payed my partner a whole years rent earlier in the year. They have a long term contract with my partner dating back to 2013. The rent totals £5200 annual.

Because the payments are flexible like that and not made every week or month will this effect our application? My partner has the the contract and deeds to the property. They are in chinese but she has had them translation by a professional translator and an official stamp from the company that did the translation. Is this enough proof?

From my estimation our incomes should be;

Carers and student bursary; £670 /mo
Partners property: £433 /mo - Taking the yearly income and dividing by 12.

We're exempt from council tax so the rent is ; £520 /mo

Income support for a couple both over 18 is 114.85/ wk or 459.4 /mo

so combined our income is ; £1103 - £520 = £583

So we should cover the financial requirements right? Is there anything I'm missing? In addition to this my partner will have worked variable hours over a 3 month period before the date we intend to apply and her hourly rate is £15 /hr and works usually 2-3 hours a week. This can also be combined right? using the total income over the 6 month period % 6 x 12?

Finally I'm in my final year of my part time study and my bursary is dated from sept 2015 - august 2016.
Will they only take the income dated from Dec 2015(the date we intent to apply) to August 2016?

I would appreciate any help
Thank you all!
