Tier 2 General married to Tier 5 YMS

Post by dlosch » Wed Jan 27, 2016 1:25 pm

Hi All,

Done an extensive research and couldn't find a similar topic. Hope I can get some help here.

I am a South American citizen and I have been in the UK just under 2 years sponsored by my employer (Tier 2 - General). My Australian partner has been here living with me for approximately the same amount of time under Tier 5 YMS. We have been together for 5.5 years and we got married here in the UK last August, on the day we completed 5 years together. Her visa is due to expire in April and we are currently looking at the possible alternatives.

I have seen many cases of Tier 5 YMS going to FLR, but then I am not a UK and/or EU citizen. Can she then apply to be a Tier 2 PBS dependent? On the other hand it is known that YMS cannot be switched into any PBS category.

I am confused now....thanks for helping!
