Spouse visa - wife dual national never settled in UK

Hi All,

My wife is British citizen by descend from mother, she was born and lived in Egypt and only had small visits to UK but never settled there.

I'm considering to apply for spouse visa for me and our child using cash savings (after selling a property) and relocate the family to UK.

I wanted to know if I can apply for the spouse visa based on her citizenship or she needs to settle in UK first before I can apply.

As long as she too will be moving to the UK permanently (and you can prove the financial, accommodation and relationship evidence), not a problem.

Does this means we need to have a residence in UK before the application (ex. rent an apartment)?

If you are a returning resident you will at least need to show you will have somewhere to stay and that it will also have adequate space for you all.
