EEA route of BC route for visa

Post by it91 » Sat Apr 06, 2019 4:08 pm

Hi all, my fiance is a EEA with permanent residence in the UK. Yesterday he got approval from his naturalisation application, and after the ceromony he’ll be British citizen in two months or so. We are getting married on 29th of june and I will apply for my visa(or residence permit) as his spouse.

My question is: Even though he’ll be BC, can I still apply to residence permit through European route? Or is his permanent residence card will be invalid?

If I have to apply through British Citizen route, as a person who has already residence permit in the UK through doctoral extension scheme (Tier 4 student visa extended until the end of 2019), can I apply to spouse visa while living in the UK? Or am I supposed to apply for spouse visa in my home country?

I would really appreciate if someone knowledgeble in this matter would give me an idea.

In short: can I apply to spouse visa while living in the UK? Is my Europen husband going to loose his EEA rights once become British citizen?

Thanks!
