Extend tier 2 visa dependent while husband has passport

Post by Cherypham » Sat Aug 03, 2019 11:24 pm

Hi, please of anyone could help. I am Vietnamese and on the tier 2 dependent visa at the moment and about to extend it. However, my husand came to the uk to study then got the job here. He got his British passport few months ago through 10 years route. However, we have just got married 3 years ago and he sponsored me to come to the uk by his tier 2 general visa.
I am not sure if I should apply via the tier 2 route or spouse visa. As he has got the British passport via long route, im confused with what to do next as don't want my 2.5 years resets again.
I read somewhere as recommendation to extend via tier 2 route but I cannot find any official link on the UK government website.
I would really appreciate if anyone could give me an advice of what I should do and what requirements and documents I should prepare.
Thank you. :)

If he has achieved his ILR through 10 years of long residence then you cannot extend your tier 2 dependant visa rather you have to switch into spouse visa FLRM which will reset your clock towards ILR to zero. However, if in future when you will complete your 10 years then all previous visas will be counted over it.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Unfortunately, as your husband was granted ILR under long residence, you have no choice but to switch to FLR(M). As you are already aware, this will re-set your immigration path to zero, putting you on a new 5 year route to settlement (ILR).

In addition to the £1,033 visa fee for a 2.5 year extension, you will also have to pay the £1,000 NHS surcharge.
You will need A1 level English from a Home Office approved test/test provider.
You will also have to meet the minimum income level of £18,600 p.a. This can be either your own earnings, your husband's or joint income.
