Spouse Visa Financial Requirement***Urgent***

Post by Bunny369 » Tue Oct 06, 2020 5:10 pm

Hello Everyone,

Am new this forum and sorry If I repeat any questions that are already answered elsewhere. Am travelling to India at the end of this month and in a rush to get some answers in regards with Spouse Visa application.

I am an ILR holder and getting married at the end of November this year and want to apply Spouse visa for my wife (future) from India in December 2020 after marriage.
Currently am self employed and I draw a salary of £2k a month (as a director) from my Ltd company since May 2020 (1st pay slip). I know that I should earn at least £18600 a year to support Spouse visa, as am getting £2k per month which is £24k per year which should be sufficient to support financial req for spouse visa application. My question is,
1. Will the payslips (last 6 months on the date of application) from my own Ltd company will be enough to meet financial requirement? (by Dec I will have 8 payslips equal to £16k)
2. Do I need to submit my Ltd company Tax returns? If yes, but by Dec 2020 my Ltd company tax returns will not be due (as company started in Feb 2020 and tax returns is only due by Jan 2021) and before Feb 2020 I had a different company which traded for 3 years but it is now dissolved, so what should I do?
3. If I solely go with my Tax returns, do my profits need to be more than £18600?
4. I leave in a rented house so do I need property inspection report?, If yes, how old it can be i.e. can I get the report in this month to be used in Dec?
5. Do I need rental agreement?
6. I heard from few people that current UK Spouse visa processing time is 6months. Is it true? If yes, is there any other visa options to bring my wife early? (other than using priority service as its currently suspended)
7. I have seen on gov.uk website that all priority and super priority services are suspended, any idea when it can be resumed again?
8. After marriage and getting marriage certificate can I immediately apply spouse visa or is there any waiting time?

And also my 1 year stay on ILR will be completed in Oct this year, So should I apply for Naturalisation before getting married or is it good to apply after getting married and bringing wife to UK? I fear that I might be 2months 3 weeks out of UK by the time I return to UK in Jan 2021, so what is the best option?

Your advice is much appreciated and many thanks in advance.

Thanks
Bunny

1&2&3) https://assets.publishing.service.gov.u ... .0-ext.pdf

4. It would only be needed if you have been sharing the place with other none-related adults. The property inspection report should ideally be dated very close to the date of application to keep it more acknowledgeable because living arrangements can be changed in seconds.

5. yes and the noc letter from the actual landlord/estate agent (excluding any lead tenant)

6. Spouse visa might only be the straightforward option given the current state of torpid activities & operations.

7. These might not be reinstated for unforeseeable future.

8. You can apply straightaway provided be capable to meet the all requirements.

Applying the naturalisation now or later is completely your own choice but if your plans are changeable or are unfirmed then better to apply when you will return back to UK, where you can apply both applications simultaneously (your own naturalization + spouse visa)

Thanks Seagul for your reply.

For 1&2&3 I have already read that document but it left me in confusion. I want some one to tell me if I can use payslip of my own Ltd company? or do I just need to submit the annual tax returns? (along with company bank statements).

If I can use payslips do I need to use last 6 months or do I need to submit all the payslips for the last full year?
In my case If I need to submit all last years payslip, I will have only 9 payslip's by Jan (as I started taking salary from May 2020) so 9x2000=£18000 which means I will be £600 short. So what should I do?

In Jan 2021 am starting new permanent job and I get £2500 for that month. As am planning to apply spouse visa in Feb 2021, So can I combine my Self employed Income (£18000) and Employed Income (£2500) to meet the financial requirement (18000 + 2500 =£20500) ?

If I want to apply Spouse visa in Dec 2020, can I submitted the adjusted tax returns for 10 months period instead of full year returns? (my annual returns due in jan 2021)

Please suggest what I can do in a simple way as early as possible, am in confused and pressure situation.

You can't use your payslips from own company to meet the financial requirement rather even can use the average self employment income of your last 2 financial year under category G (if your self employment is older enough for this). Also if you have sufficient cash savings then you might not need of anything else.

Thanks Seagul, I appreciate you for taking time to answer my queries.

I haven't got sufficient cash savings so its out of my options.

I can go with the option average self employment income of last 2 financial years, but the current financial year ends in Jan 2021, so I need to wait until then to apply spouse visa.

Yes as you have to. Alternatively, you can request your prospective employer to hire you earlier (if possible then now) instead in January 2021 for a straightforward case in near future.
