Bringing my mother to uk

Post by shohjura » Thu Jan 14, 2021 11:38 am

Hi guys,
I hope everyone is well.
I and my brother live in uk (myself applied for ilr and my brother is student at uni). I have got younger brother and my mother left in my country. My younger brother is also in the process of transferring his studies to uk in a couple of years.
If all of his sons are in uk, what are my mother’s chances of getting the elderly dependent visa on grounds that she needs care by us and that we are based all in uk?

Many thanks

The approval ratings on adult dependent relative are very low since its introduction so you need to fulfil the requirement.

Of course it can be approved if done properly and all evidence listed in the Appendix FM have been addressed but it all down to caseworker looking at the application.

It is the most diffcult visa to get with a very high refusal rate. If you choose to take the risk and it is refused, it shuts the door to any future visit visas for them too.

Below is what you would have to prove.

Char (CR001 not Casa)

For an Adult Dependent Relative visa, the questions that you need to answer are (a) whether the applicant needs assistance with daily tasks, such as bathing, washing, cleaning, etc AND (b) whether such assistance is either unavailable or unaffordable in their home country.

Generally it is harder to prove that such care is unavailable and unaffordable in the Sub-continent. It is certainly more affordable there than in the UK.

As per Home Office stats, only 6% of ADR applications are successful before appeals and even after appeals, the total success rate is only 22%. So effectively, even after appeals, the failure rate is almost four out of every five ADR applications.
