Spouse visa extension FLR(M) queries

Post by True » Wed Mar 03, 2021 1:11 pm

Hi all :D

I imagine it's a bit soon to post my queries on spouse visa extension- 5 year route FLR(M), but I want to be prepared when I have the time to do so instead of panicking when I am closing to the end date.
My brp card was issued on the 15/05/ 2019 and is valid until the 20/02/2022. I however entered the U.K on the 10th of June 2019. Taking into consideration the condition which states" the date of application should not be more than 28 days before the current spouse visa expires" , does it mean I will be eligible to submit my application only after the 24th of Jan 2022? I also read somewhere that we can apply for an extension after staying in the U.K for 2.5 years, which suggests that I can also apply after the 10th of Jan 2022? I am slightly confused with these two information and any advise from experienced board members would be very much appreciated.

My other query is around co- habitation evidence documentation- My husband and I have our joint water bills to corroborate as evidence, however since I have taken on my husband's surname legally, my name on these bills reflects both my previous surname and my new legal surname. Will this cause any issue? Alternatively, we are compiling a dossier of any correspondence addressed to either my spouse or I. So my question is - will any letters, even its from our pet insurance company, tesco , etc be used as evidence of co-habitation?
Thanks.

On what basis did you come to the UK? Fiancée or spouse visa?

You will complete 30 months in the UK 10 December 2021 calculated from the date you arrived on a spouse visa which means you can apply anytime from Dec 2021 or you can also apply 28 days before your leave is due to expire or 28 days before completing 30 months. All of this options are viable but just make sure you don't apply too early. hence, you can apply anytime from completing 30 months to protect you for future ILR.
