Spouse Visa and ECAA Turkish Business Person Dependant Childs

Hello every,

I am the main applicatant with ECAA Turkish business person visa. I will apply Entry Clearance Visa for my wife and four children, who live in Turkey.

I know that for my wife, I will have to apply for spouse visa, hence need to meet the financial requirement. However, According to https://www.gov.uk/turkish-business-person, unlike spouse visa, there is no threshold to meet financial requirement for child dependants.

So my question is that when I apply for my wife, we will have to fill details for each dependant that will travel with her, then next question is as follows:
Additional sponsored children

Is XYZ currently sponsoring any additional children?

You should tell us about any additional children they are sponsoring who need a different type of visa to enter or remain in the UK

Do not include children who are:
  • dependants applying on this application
    over 18
    British Citizens
    settled in the UK
    EEA nationals with a right to reside in the UK under the Immigration (European Economic Area) Regulations 2016
-Yes -No
As an ECAA Turkish visa holder, should I chose NO for my children? Or Yes? If I say yes, they will have to meet the financial requirements?

There is no Minimum Income Requirement for either the spouse or the dependents of a Turkish ECAA visa holder.

You would however have to meet the adequate maintenance and accommodation standard for all dependents, both spouse and children.
Financial requirement for a dependent partner or dependent child on the ECAA Extension of Stay route
ECAA 14.1. There must be adequate accommodation provided by the ECAA worker or ECAA business person for the applicant.
ECAA 14.2. Where the applicant is the dependent of an ECAA business person, the profits of the business or businesses must be sufficient to maintain the applicant and any other dependents in the UK.

Hi Simpn, thanks for your reply. However, this is for Extension Route only whereas my wife’s and childrens applications are going to be Entry Clearance.

Assuming this information is also valid for children, do i have to say “No” (refer my original post) while applying for my wife visa? I hope that makes sense.

I truly appreciate your reply. If I say YES, the next step asks me, How many additional children are they sponsoring? and when I say 4, in the next step financial requirement increases from £18600 to £29600 as seen in the images below. In this case, should I choose NO, because only my wife is required to meet the financial requirement?

You cannot apply for a spouse visa under Appendix FM as you are not British or Settled (ILR).

It also seems that you are only able to bring children as this route visa has actually been closed.

New applications for the Turkish Businessperson visa have closed. Only children under 21 (‘child dependants’) can apply to join you in the UK on this visa.
Your children will be unlikely to get a visa due to your spouse not being able to get one.

You will have to wait till you have ILR to bring your family and you will then have to meet the strict financial requirement. Your will also only be able to bring children on the settlement visa who are under 18 years of age.

Hi CR001, thanks for the reply.

-Bringing children with this visa has not closed.
-My children can still get their visa with the permission of their mother. However, this is not the case I would still like them all to move here with their mother.
-I don't have to wait till ILR. My only concern is while I read ECAA Guidelines, there are no financial requirements for children.My children will still apply through the link you shared me with, I am sure for this.

However, while applying for my wife, as my children are kind of exempt from the financial requirement and as they will apply at the same time as their mother, what exactly should i do giving information about dependants?

Applying from outside the UK
Your children or those of your partner can apply to come to the UK if you have a Turkish Businessperson visa. They’ll need to apply for a visa as your dependant.

If you’re already in the UK and want your child to join you, they must apply online for a dependant visa.
As of 1 January 2021, I know that spouses of ECAA Turkish business person who apply first time must apply for a spouse visa other than ECAA dependant. However, Child (aged under 21) of a Turkish worker or businessperson, or a child (aged under 21) of the partner of a Turkish worker or businessperson still can apply as a dependant visa.
