Spouse Visa extention - Home Office now asking for Sponsor Consent

Post by Can2UK » Thu Aug 31, 2023 2:19 pm

I've applied for an extention to my spouse visa and I've gotten an email from the home office saying that I am missing part 2 of the consent paperwork which pertains to a sponsor. As far as I was aware I didn't need to provide that for a spouse visa so I left it blank.

I don't have a sponsor since this isn't a work related visa. Currently my spouse and I are living with her mother so I've provided proof of residence for both us and her along with the acknowledgment from her stating that we live with her. We do not have any joint accounts, which part 2 of the consents also addresses.

I'm a little confused by this, can anyone possibly shed some light on this?

I've been in contact with a friend whose married to an immigration lawyer so see what their thoughts are and will update this with whatever happens.

Your "sponsor" is your british spouse for visa purposes, otherwise you wouldn't have a spouse visa.

You are required to provide part 1 (you) and part 2 (sponsoring british spouse). You have provided documents with your spouses name on so ukvi require the consent form.

It is part 3 of the consent form that is the one not required.

To confirm, part 1 was for myself to fill out. I had my spouse fill out the family declaration which I submitted but I also need them to do the part 2 of the family consent?

I do see looking through the original consent forms that part 3 is specifically for other sponsors, so I assume it's safe to have left that one blank?

Additionally since I've provided proof of residence for her mother do i need to submit a part 2 consent for her as well?

Thank you for your quick reply.

Just part 2 for your spouse is required.
