Spouse visa

Post by siri_uk » Mon Jan 05, 2009 5:22 am

Hi

We applied for a spouse visa for my Indian wife from Bangalore on 24th November 2008, I am concerned that the visa may get refused on grounds that I am on benefits. I am currently in receipt of DLA, Incapacity benefit and Income support. My wife has a job offer from the UK, will this be taken into account for earning, as with this employment she will not need to claim public funds. The problem is the employment is that it is with my brothers company, he has advertised the job in the UK but has had no response, so proceedures where followed, she is well qualified to do the job, she should have started on 15th December, we explained to him that she would not get the visa in time and agreed to give until the end of January before he readvertises again (it is a construction firm and during December, January, February work goes slack). She would earn 350 a week from this job, will they accept this and add it to the income? Will they have a problem with it being my brothers company employing her? He has told me to tell them to call him to verify the details, will they do this? We have done our best to gain employment for her before we return I just hope it is enough. I currently live with my parents in 3 bedroom house, so 1 bedroom is occupied by them and 1 will be occupied by me and my wife, will this be ok? My mum gave me an invite letter saying we could stay there. Also as I am on DLA, do I need to write a letter telling of my medical condition, or will the letters from the DWP stating that I am on DLA be sufficient. Will they have looked at the application yet or do they just queue until it gets to the top?

Thank you and sorry for the long post
