Fiance visa/marriage visitor visa decree absolute requirement

Hello,

My non-UK fiancée and I would like to marry and live together in the UK. I am a UK resident currently awaiting a divorce to finalise, and I understand an application for a fiancée visa can only be made once the decree absolute is received (E-ECP.2.9. (i)). However, the marriage visitor visa only specifies the applicant needs to provide this if they were previously married; is it possible to apply for this while awaiting the finalisation of the divorce?

1. Both have to prove they are free to marry for either visa.

2. You cannot switch to a spouse visa within the UK if your partner comes on a marriage visit visa.
