I'm British, can I apply for a residence permit for my mom?

Post by Gimgim » Wed Jun 15, 2011 9:41 pm

Hi all,
Hope one of you out there can help me.
I'm originally from Brazil but I do hold a British citizenship.
My mother came over from Brazil on a 6 months tourist visa.
I would like to know if I can apply for a resident card for her, being my dependent, so she can legally work and live here in the UK?

Your help and opinions would be much appreciated.

Thanks
Gim

How old is she? Is she married? Does she work or have a home she owns? Does she have relatives in Brazil? If so, who?

She is 50, not married, does not have a job in Brazil. She does have some relatives such as brothers and sisters but all very far. Bear in mid that she is already here in the UK.

Thanks

If she doesn't meet this requirement:

317 i) e) parent or grandparent under the age of 65 if living alone outside the United Kingdom in the most exceptional compassionate circumstances and mainly dependent financially on relatives settled in the United Kingdom
then she has no chance, and from what you have said, she doesn't meet this requirement.

she is in the UK as a visitor which means that she recently convinced an immigration officer or an entry clearance officer that she had sufficient ties and resources in Brazil so as to show she had an intention of returning there at the end of her visit in the UK. The fact that she is currently in the UK therefore doesn't really help her.
