Tier 2 General Visa Extension

Post by hayat2014 » Mon Mar 03, 2014 12:45 pm

Hello,

I am on Tier 2 General Visa (From 01-Sep-2011 to 01-Sep-2014) issued in august 2011.
My Wife is My Tier 2 General Dependent (visa issued same time as mine)
I also have a 13 months daughter born in UK (no visa yet)

I am Planning to extend my visa with my two dependents.

Details on my current COS are as below: (COS issued in 2011)
Job title: QA MANAGER
Job type: 1136 Managers, information and communication technology
Summary of job description: Manages testers and lead testers. Responsible for handling personnel issues, equipment needs, and costs incurred by their teams.
Gross pay in pound sterling: 27300.00 For each: Year

I am working for same employer in same role and performing same duties
My Salary is now: £36000

As you are aware SOC 2000 has now been superseded by the new SOC 2010 system, my job Code 1136 now maps to:

Previously SOC2000
1136 Information and communication technology managers NQF 6

New SOC2010
1136 Information technology and telecommunications directors NQF 6 (appropriate salary New entrant: £25300 ,Experienced worker: £78600)
2133 IT specialist managers NQF 6 (New entrant: £25500, Experienced worker: £40000)
2134 IT project and programme managers NQF 6 (New entrant: £26700, Experienced worker: £36400)

My Questions:
  1. I assume RLMT is not required but just to confirm, Is RLMT required in this case?
  2. When applying for COS, which SOC code shall my employer use? 2133 or 2134, given my salary is 36000 and will I be able to claim points for appropriate salary if I use the code 2134 when applying for visa extension (2134 required pay is 36400 but my pay is 36000)?
  3. As my visa is expiring on 01-SEP-2014 When is the earliest I can apply for visa extension, Can I apply in March 2014? (My employer however needs to request annual allocation in SMS for 2013-2014 as current allocation level is 0)
  4. Can I use letter from my sponsor for maintenance of funds requirement (for me my wife and daughter). or I will have to maintain funds in my/ours account.
  5. Do i need to apply for visa for my daughter (to be my T2 dependent on current visa) before making extension application for all 3 of us?
  6. WorkpermitDotcom what is the fee for this case if I apply through you.
Thanks in advance

Hello

I am not 100% sure about my answers..but hope it helps you a little

1. I assume RLMT is not required but just to confirm, Is RLMT required in this case?

No, RLMT is only needed for new hire. As you are extending your visa within the current role and same company, RLMT its not needed.

2. When applying for COS, which SOC code shall my employer use? 2133 or 2134, given my salary is 36000 and will I be able to claim points for appropriate salary if I use the code 2134 when applying for visa extension (2134 required pay is 36400 but my pay is 36000)?

I am afraid, that you can't use either of these codes, Because as you know you cant claim points for minimum salary req for £36000. If you want to use 2134 then your sponsor should raise and state that you will be paid £36400 or more. Else your application will be rejected.

3. As my visa is expiring on 01-SEP-2014 When is the earliest I can apply for visa extension, Can I apply in March 2014? (My employer however needs to request annual allocation in SMS for 2013-2014 as current allocation level is 0)

Yes you can make an early application for extension. But I guess its not necessary for annual allocations. As you are already in UK and making an application for extension for the same job position

4. Can I use letter from my sponsor for maintenance of funds requirement (for me my wife and daughter). or I will have to maintain funds in my/ours account.
Yes you can get letter for your whole family from your sponsor if they are A rated

5. Do i need to apply for visa for my daughter (to be my T2 dependent on current visa) before making extension application for all 3 of us?
Yes, Of course you will have to take dependant visa for your child.
