Discretionary Leave Extension Procedure

Post by shingi » Tue Mar 04, 2014 10:23 am

Hi All

I am curious as to what i can do with my situation, so i wiould appreciate if anyone could assist

Jun 2005 - Entered UK with 3 year Student Visa
Aug 2008 - Visa Expired and overstayed
after an application for assylum which was declined by Home Office but appealed at a court (Tribunal maybe) and overturned by the judge i was given Discretionary LR set to expire 04 Apr 2014

I am looking to find out out what to do as there is now one month to go and i read somewhere that i could only extend in this last month.
Which form do i extend with or what is an alternative more feasible course of action ? Where is all the relevant material such as the forms located and fees and does anyone have enough knowledge of the procedure to detail a timeline

will i have to stop working in the meantime

what supporting documents or evidence will i need to show ?

Thanks Amber, i have seen the form and a further few questions have surfaced as my immigration history is somewhat complex to say the least.
After the refusal for my assylum application, an appeal was lodged and after the judge overturned it, i was initially sent a leave pertaining to asylum until 2 months later when a letter was sent to me requesting that i return this visa which i duly obliged, i was then sent a visa which stated that i had leave to remain for a reason not covered by immigration rules, - is this something the home office could use against me and what is the probabilty that they will decine my aplication ?

No. Leave outside the rules/DLR is what you have. Just make sure form DL is correct if your leave approval letter says leave was granted under Article 8 ECHR then then the form is FLR(O).
