ILR and Court Hearing

Dear Guru
on behalf of my friend i am writing....
My 10 years will complete in September 2014 and my court hearing is in October 2014..

There are 50/50 chances to win the case
What should I do in this situation

My wife is here for 4 years and
my child is born in this country

I am on student visa and my application is rejected due to 5 years cap....
