Tier 1 (G) dependant ILR application query ?

My husband got his ILR on Nov 2013. Am currently in Tier 1 (G) dependant my visa is valid till September 2014. I entered Uk on Nov 2012. I have previously been to UK in September 2008 and I was under work permit dependant visa and left UK on May 2009. I did my master Degree in India so I didn't come back to UK in between and I didn't apply for any visa in the meantime.
My question is :
1. Can I add my previous year stay in 2008 to apply ILR ? I have some proof like water bill, NHS card and tenancy agreement as proof for living together ,
2. Do I need to extend my visa ? If so what is the right form?
3. Is there any absence rule for dependant. ?

This is my case. I am currently on Tier 1(G) dependant my husband got his ILR on November 2013. I entered UK on November 2012. My visa is valid till September 2014 with 2 months shortage to go for ILR. I have previously been in UK on September 2008 under work permit dependant visa and left UK on May 2009 due to health reason and I later plan to do master degree in India so I didn't enter to UK in between and I dont have any visa. Meantime my husband switched to tier 1 (G) in 2009.

My question is:
can I combine my previous stay and apply ILR ? I have some proof like NHS card, bills, tenancy agreement.

did you mean my work permit visa?
It was granted for 5 years since 6th september 2008 valid until 20/09/2012. But my husband changed his visa to Tier 1 General in 2009. Thanks

You may extend as a PBS dependant until you qualify for ILR.

Unfortunately, your 'continuous leave' may have been broken. So, 319E(d)(ii) probably applies.

Thanks vinny for the reply. I entered back on Nov 17th 2012 under tier 1 (G) dependant and it is valid until september 2014 with two month shortage for continuous 2 year qualification period.

Also when will I qualify for ILR as I have entered the country in September 2008 as a dependant before. Does the new rule ( that the dependant should wait for 5 yr as main applicant to qualify for ILR )which changed on July 2012 affect me ?
