HELPR REQUEST FOR WIFE'S DISCRETIONARY LEAVE TO REMAIN

Dear Sir

Can you kindly help me out about my wife's extension in discretionary leave to remain application due in October 2014.I mention below some facts about her stay in UK

1 - She arrived in UK in August 2006 as my dependent . I was on student Visa then.
2 - In 2007 she extended her visa as my dependent again I was on Student Visa
3 - In September 2008 I got HSMP till September 2011 . My wife got extension as my dependent till September 2011.
4 - My Indefinite leave to remain was due at the end September 2011 without further HSMP visa extension. I got my ILR without any problem in October 2011 . However , my lawyer applied my wife visa not as my dependent rather applied on FLRO form as discretionary leave to remain. She get 3 years visa in October 2011 to Oct 2014 as discretionary leave to remain . There was No restriction on public sources / funds ( She can take benefits ) . Also No limit / limitation on her traveling. I am taking Child benefit ( I have one daughter , Also I get Child tax credit and working tax credit in my own name . Her name use in working tax credit as I can only apply that as family ) .

My question are

1 - What will be the best application in my situation . She has already stay in UK more then 7 years . So Can she apply on indefinite leave to remain on humanity grounds . If she applied for ILR then

(i) What she needs to do / provide for successful application . eg Life in the UK test , B1 Certificate etc
(ii) When she should apply for Indefinite leave to remain . i.e NOW or in October 2014 ( When her visa expires ) .

2 - If its more appropriate to extend on discretionary Visa then

(i) What FORM should be used
(ii) Any fees applicable .
(iii) When to apply that extension
(iv) Should I use same / any solicitor .
