Cooling off Period on ICT Tier 2

I have ICT Tier 2 long term staff visa valid till Feb-2016. I came back from UK in Jan'14(was in UK from Feb'13 - Jan'14 on same visa).

I'm looking to apply for Tier 2 visa. Can anyone please let me know if 12 month cooling off period starts when I came back in Jan'14 or after my visa expires (in Feb'16).

Any help on this is highly appreciated.

The cooling-off period starts from the day you traveled back to your home country. But you might need to provide enough evidence on your return travel to your home country before the visa expiry day, when re-applying for T2 visa after 12 months period.

Thnx for the response.

So just to confirm,since i traveled back in January'14,i am currently in the cooling-off period???

It means I should be able to apply for Tier -2 visa after January'15 (considering I am not travelling to UK for next 12 months) although my Tier -2 ICT expires in Feb'16.

Please let me know if my understanding is correct.

You'll have provide evidence that you haven't been in the UK as a T2 migrant at any time during the cooling-off period (Jan 14 - Jan 15). Your travel ticket for leaving the UK in Jan 14 is not sufficient for that.

Thanks Manci and t2ict for clarification.

What is valid evidence to show that I have not travelled UK on during my cooling off period. Is immigration stamp on my passport sufficient enough evidence to show my last travel date.

During the cooling-off period you can travel to the UK as a visitor but not as a T2 migrant.

Evidence could be to do with your work or study abroad
