what to do next?

Post by koshynita » Sat Jul 14, 2007 6:23 pm

Dear sir/ madam,

I was wondering if this forum could help me plan naturalisation for me and family.

I was given ilr on 25 th sept 2006 based on my continuous work for 10 years in uk.

My 2 daughters aged 6 & 10 as well as wife was not given ilr and currently on 2 year dependant visa.

I didnt have to write the citizenship test for ilr , ...but planning in advance my wife recently gave the test and passed it.

How do i go about organising things for myself & family?
what are the requirements for myself & family.
If naturalised do children also become naturalised ?

Your thoughts would be much appreciated .

Thanking in advance
yours

You got your ILR on 25.09.06 and thus on 25.09.07 will have had that ILR for one year. Your next step is for you to pass the Citizenship Test and assuming you have passed that by then, apply for your naturalisation any time from 25.09.07 onwards ... but do ensure that you were physically in the UK exactly 5 years before BIA will receive the application.

Making that application in late September should ensure that you are a British Citizenship by the end of this year, or certainly some time in the first half of 2008.

Now your family! Currently in the UK on 2-year visas .... spouse visa and child settlement visas. They should apply for their ILRs in the last 28 days of their current visas. Then, assuming you are British by then, as soon as they have their ILRs your wife should apply for her Naturalisation, and also Registration applications made for the two children. Your wife should ensure that she was physically in the UK exactly 3 years before BIA receive her Naturalisation application.

So taking all that together, all of you could be British by the end of 2008.

Was either daughter born in the UK?

thankyou for your comments john & jaj,

Both my children were not born in UK.
My wife has been in uk continuously since 2003 & was in uk with approx 4-6 months absences etc previously since 1999.

Hence can they not apply for ilr soon after my naturalisation or should they finish their current 2 year visa?
As far as children are concerned once i am naturalised cant they apply for citizenship straight away?

is there a link which you could forward me to read up on these issues?

many thanks

Your wife needs to have ILR before she can apply for her Naturalisation. You changing from ILR to being a British Citizen does not speed up when she can get her ILR. But it does mean that she can apply for her Naturalisation as soon as she has her ILR, instead of needing to wait a further year.

They also need their ILRs before it is possible to apply to Register them as British.

Accordingly I still think the timeline set out in my previous post is correct. (But will not be surprised if JAJ to mention the "ppron method"! )
