Hi gurus
I have got situation that i need to switch from dependent to main applicant. Iam working in UK, I know i cant apply within the country but question here is if apply outside UK how much will be the minimum salary threshold and my employer has to go through RLMT. Is the cooling period is also applicable to tier 2 dependents. Please some one help me im in desperate situation. Thanks

Cooling-off is not applicable in your case. The sponsor will need to assign a restricted CoS after the RLMT has been completed (unless an exemption applies). The min. salary is £20,300 or the min. corresponding to the SOC code, whichever the higher. The skill level has to be NQF 6 unless the job is on the shortage occupation list. See:

Hi manci thanks for your quick reply. Im already working for the company still do i need to go for RLMT. And wat happen to my partner visa if i go back to my home country and i apply visa. If i got rejected the visa do i still hold my previous visa. Iam sorry guru im asking too many questions. It will be great if you can provide me answers to my questions

yes (unless your job is a shortage occupation) but the RLMT is done by your employer, not by you

Yes, Your employer needs to go for RLMT before applying for your restricted CoS.
2, wat happen to my partner visa if i go back to my home country and i apply visa -
Your partners can continue with the same visa or he / she can apply as your dependant. but she / he has to do out-country application.

Can you please clarify below? Appreciate your help.
I am currently working as Tier2 ICT Long term and my wife is on dependent visa. She is currently in India and she is switching to Tier 2 general through another sponsor and applying for visa from India with in next 2 weeks. Once she gets visa, i am planning to apply as a dependent from india in December when i go for holiday.
1) Once i switch as Tier2 general dependent, can i travel to UK without main applicant travelling? I am planning to come back in December and my wife is planning to come back in end of Jan 2015.
2) if above is not allowed, can i switch to Tier 2 dependent from UK once i come back from holiday while my wife is still in india(after getting tier 2 general visa)
appreciate if you can clarify above.

you can apply from within uk, and technically speaking there is nothing stopping u from applying within the uk before your wife comes back. However, it maybe a good idea to wiat till she comes to uk.
I dont think u can apply from dependent visa and then come to uk before she comes.
but this all is obviously my opinion and others might correct me.

No, you cannot do that.

No, you cannot apply as depandant from UK while the main applicant is not in UK. You can do it once she has entered UK.
