non EU elderly dependants

Hi,

If someone has dual nationality ( British and Portuguese ) and living in the UK, can they bring their non EU elderly dependants parents under Portuguese citizen ( EU ) to join them in the UK?

It is impossible to bring them as a British national under new law.

Can some one advice ?

Technically no.

British citizens are viewed as being British only (no matter how many other citizenships you have), unless they have been through the Surinder Singh route, where they work in a country of which they are not a citizen, e.g. France/Spain in your case.

After that you could (if you satisfy the new rules for Surinder Singh) apply for an EEA family permit for your non-EU elderly dependent provided you are able to prove dependency.

it used to be but they changed the law in 2012
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020
Passport Approval : 21st Feb 2021
