Changing VISA Status From Student to HSMP

Post by the_Mana1 » Sun Jul 15, 2007 5:26 pm

Pls Can anybody help with this unusual situation, I came to the Uk on a student VISA, I completed my program, and I tried to switch to FLR(SEGS) after my program but i made the application 8 days late, therefore it was refused.
Before the Home Office took the decision on my FLR(SEGS), I had also made an FLR(S) application so that I can attend my graduation and can continue to study in the UK.
While waiting for the Home Office decision on my FLR(S) application, I got a good job offer and my employer made a work permit application on my behalf, which was successful, but the immigration consultant who handle the work permit on behalf of my employers advised my employers that I cant switch to FLR(IED), because my previous FLR(SEGS) application was refused and my employers made the decision not to take my FLR(IED) application any further.
During this waiting time, I made a successful HSMP application and I now have my HSMP approval letter.

Eventually, I got a further leave to remain on FLR(S), I have also got an HSMP approval...my question now is, can I switch to FLR HSMP now, making it in-country switch even though I have not commenced my studies for which my current FLR(S) is based on.

Crikey, how much was all that on visa costs!???

Need to re-read this a few times I think but from what I can see you have HSMP, you are still on student visa (extended) the question is can you switch in-country?

BIA site says you can switch in-country if u r a:
Student who has successfully obtained a degree level qualification on a recognised degree course at either a UK publicly funded further or higher education institution or a bona fide UK private education institution which maintains satisfactory records of enrolment and attendance.
So I think ur safe. Wait for others tho....

If you have sucessfully completed a degree from UK and the Degree has been conferred, you can certainly apply for switching to HSMP VISA (in country) by applying for FLR(HSMP)
