Query On Tier2 ICT Long Term VISA

Hi,

I went to UK on Tier2 ICT VISA on 22nd Nov 2009 and was having the VISA until 08/10/10. I got the extension f my Tier 2 ICT VISA from UK and got the VISA till APRIL 2012. Again i have extended the Tier 2 ICT VISA from UK and got the VISA till APRIL 2014.

I stayed in UK continuously from 22nd Nov 2009 till DEC 2012 and returned back to India by the end of DEC 2012 as my company asked me to work from offshore location. During my return to India on DEC 2012, my company has updated UKBA through SMS report indicating that i will be temporarily working in offshore (in India) but will return to the UK & continue my UK assignment shortly. In short, they haven't cancelled my COS.

Depending on the above situation, My question is

1) can i apply the new Tier 2 ICT VISA from India after April 2014 or will i be caught in the cooling off period? FYI, my UK salary will be above 41K.
2) If am returing to UK with the same VISA now and get the VISA extended from UK in April 2014, can i be considered for applying the ILR? If so, when can i be eligibile for applying the ILR considering my 1.2 years of non-presence in the UK.

It would be great If you could respond to my above queries at the earliest.

Leave to remain (extension) will not be granted if you apply from outside the UK.

To be eligible for ILR on the 5 year route your absences must not exceed 180 days in any of the 12 month periods calculated backwards from the date of application

Can you please let me know, if i am travelling to UK and extending my VISA from UK by April 2014 and continuing for the next 5 years in UK without exceeding the absence for 180 days in any of the 12 months period in those 5 years, will i be eligible for the ILR after april 2019.

hi ,

your help would be much appresiated to star filling my application form...

section 3 which category.... this section is bit confusing me to tick one...
i came in to this country on 4 feb 2010 and my employer bought me here doing all the paper work... so i was thinking i should tick work permit holder but my brp card has a line saying tire 2 (general)...

Thanks manci. What are the other requirements which you are mentioning in your response? Also in those 5 years if am switching from Tier2 ICT to Tier2 General in UK itself if am still eligible for ILR?

Hi Manci,

Can you please let me know if i will be allowed to travel to UK now for the same project and the same company with one month valid visa as my visa is expiring on 14th April 2014. If i explain in the immigration that i will be extending my VISA after entering UK, will i be allowed or will i face any poblem in the immigration?

you shouldn't have problems at the UK border
