Determination Letter Recieved

Well i had an tribunal hearing on the 20th april and i recieved a determination letter on the 21st May. the judges decision is as follows, I ALLOW THIS APPEAL. But after reading the cover letter it states the HO have 5 days to appeal. I wanted to know how often to the HO appeal a judges decision. By then way it was a First tier tribunal?

Yes they have a right of appeal but they only do it if there was a serious error in law in the adjudicators decision.

I don't think it will apply to you so don't worry. Just look forward to getting the visa stamped in passport soon :wink:

Thankyou so much bro btw it's my wife's visa which was submitted in 2008 and been rejected under paragraph 281 and 320a so the case is proper faced but inshallah she should get it now cos I have not been in the wrong Allah sees everything and knows best well inshallah I should get it waiting till 31st may 4pm which is apparently the deadline

Hi everyone, I was in Newport 2 weeks ago for immigration case after it was refused last year and the judge granted my appeal right there and then at the end of court. But now I'm waiting for determination letter and it's been 2 weeks. Also hear that it can be appealed so worried they will appeal the judges decision. :(

I was allowed appealed in the past but the home office used its right and appealed against the judge decision straight away without informed me which is against the immigration rules however I won the second one as well. The home office willing to stop and hard for anyone that is why. But don't worry I hope you will be fine and Good luck.

I got my determinAtion letter on the 27th of February. I now need to wait the 5 days out to see if they will appeal. So stressed that they will :(

There was no appeal! I'm so happy now but I've been told I can live here for 30 months then must apply again? Also how long will it take before I get everything I need so I can start work?
I hear up to 12 weeks?

They will not be in a hurry to implement your appeal.After 3 months if you havent got your papers tell your lawyer to write to them and if there are still any more delays write to your mp( hope your mp isnt conservative) and tell them how you are suffering etc because you cant work and ask him or her to find out from the border agency is taking months to issue you with your papers after succesfully winning your appeal.

Can it really take 3 months to get my passport etc back from ukba? I need to start work. It's only been 2 weeks I'm waiting so looks like I'm going to be waiting forever now. Anyone have a number I can call as the one I have just puts me to automated robot thing.

I'm confused, I have Leave to remain for 30 months. So when I apply again can they refuse? Been ongoing struggle to get my paperwork and biometric card from ukba. Every ca I make turns out to be a dead end. Really frustrating. Then I got told this morning I mustn't push for my passport because I might get it with out a stamp in it. Totally lost. Please help

I'm not 100% sure of my suggestion but why not give it a try.
You can apply for work and they can confirm from HO if you have right to work,you don't necessarily have to take your stamped passport to proof that,since you had right to work before and you already have your determination letter with you.
Just give it a try.

No, let me explain. I came here two years ago on a holiday visa. Then left back for South Africa, then came back to the uk and went to a solicitor to try and get to stay here. Being gay I went on human rights. Was never allowed to work here through the entire time of case. So now I've been offered a job but they want a national insurance number. My solicitors are not returning my calls for 2 weeks now and I'm lost and dnt know what to do. I dnt want to lose out on this job as it's a very good one. Do u know the time span it takes to get everything back after u have been successful? Thank you for answering me and ur time, much appreciated.

My Lawyer has received a determination letter unfortunately it was not good news for me so i have to appeal again. :cry: the question is who should have received letters as previously all correspondence was sent out in sets of 3 one to myself at the UK home address one to my husband at the UK home address and one to the lawyer. previously the home office have lost their entire copy of my file and this was not even brought up in the hearing. this time they have not sent any letter to our home with the result of the appeal determination luckily my lawyer has received hers but the question arises has this been a strategic failure so they try to make me miss my appeal deadline or just another incompetence on the home offices part? I wondered if anyone else can answer the question on who should receive letters with the outcome of the appeal determination.
