College failed to renew HTS just before exams

Hi

I am the guardian of a student, who small college only had the one Tier4 student and found the sponsorship application process lengthy and confusing with all the changes. They wished to withdraw but failed to appreciate that this would result in the student losing his visa just before his A-level exams. He was given 60 days to find a new sponsor, but locally exam boards did not match and it was impossible to find a college willing to risk their own HTS status by enrolling him to attend classes at another college. He has offers from Universities if he get his exams but has now had to leave the UK. He is hoping to apply for a general visitor visa and state his purpose is to take exams and seek entry to University rather than solely study. He attended every lecture on his courses and has not missed a day.

Under the caseworker guidance notes his case does not fit with the mandatory curtailment advice. We feel the UKBA should have used discretion on his case as none of this is his fault and he has been an exemplary student.

Does he have a case to appeal or at least ask for special treatment on issuing a visitor visa to complete his exams.

Do they still have the license? If they still have the license and at lease have the B rated sponsorship they could still sponsor any existing student so the student can complete the course.

Otherwise as you have mentioned student come under the general visitor visa and sit for the exam should not have any problem at all as long as he is meeting all the requirements.
