Applying for PR EEA3 employed but in a low income

Hi Guys,

I have been leaving and working in the Uk for nearly 8 years, I am Portuguese, my husband, Brazilian, have Permanent Residence. I want to apply for my PR.
For the past 2 year, I've been working as a carer for a lady, that is my only job and I get only £340 per month. I never asked for any benefits, as my husband pay all the bills and I decided to take time and study at home to improve my English a bit.
am I gonna have problem applying because of my low income, and also, I didn't pay any tax or NIN. Before, I worked full time and was paying tax and NIN, its only this last 2 years that I've not worked full time.

Another question, my husband has the Permanent Residence but he is not member of EEA, we don't have children yet but, is he going to be able to register our children as British citizen or has to be me after get PR?

Not too sure but I don't think it will be a big problem because you have been working in the UK for so long.

Have you still got all the records from your previous full-time job? E.g. pay slips/contracts etc? Hope so, as you will need to prove that you've been working in the UK for 5 years continuously.

I think it should be easy for your to get PR, especially if your spouse got PR based on the fact that you were exercising treaty rights. Is this the case? Or did he get PR based on some other relationship to another EEA national?

I'm not sure what they will think about your recent salary - but some other forum members will likely be able to give more info.

Yes, I still have all the records from my previous job, and my husband got his PR from me.

If he got his PR through you, that means you actually already have PR as the Home Office has acknowledged that you have exercised your treaty rights in the UK for 5 years (otherwise he wouldn't have got PR).

Now, to get a document proving your PR you just need to illustrate what you were doing during those 5 years (and more if you like). You apply on form EEA3 and your application should be dealt with quite quickly.

I guess the question is why do you want to apply for PR Confirmation. You don't need to apply to have the status. You got it automatically (and that's why your husband got it). Any children born in the UK would be British from birth if one of the parents holds PR status (you both do).

So, when I have kids and want to apply for their British passport we can send my husband''s passport together with the passport form? I wasn't sure because despite him having PR his passport is brazilian. I know it's sounds silly but we never know with the HO.
And what is the difference between PR and Ilr for EEA family member?

Yes. One parent passport (even if not EU one) with PR Confirmation at the birth of the UK born child is enough.

PR for EEA and ILR are very similar (there are very subtle differences). They are just obtained through different immigration routes.
