Tier 2 ICT Long Term to Tier 2 General Dependant

Post by jaisun » Sun Mar 23, 2014 11:46 am

Hi All, Manci

I have got a Tier 2 ICT Long term Visa issued in Dec 2012 expiring in Jan 2015. I work for a Indian company with my client being a multinational company(Bank) . Now the bank wants me to work for them directly and not through a third party. They are ready to sponsor me .So I would like to discuss options for staying in UK.
a) Reading the ICT rules it seems I cannot change my sponsor within UK and I have to go back to my home country and 12 months cooling off period applies. Is my understanding correct?
b) My wife who is on a Tier 2 ICT Long Term dependant visa is working for a UK based company from past 7 months. Her company is willing to sponsor her for a Tier 2 General Visa . I read in the forums that her company has to do an RLMT and then she needs a restricted COS. Can she get her visa switched while staying in UK?
c) If b is possible, then can I get switch to a Tier 2 General Dependant visa and then change my organisation? Will I have to go back to my home country ?
d) Does the cooling off period apply for c?

Please advice what could be the best way method for us to extend our stay in UK.
Thanks,

From my understanding on reading the other threads,

a) yes your understanding is correct
b) yes your understanding is correct, but your wife will need 'entry clearance' that means she cannot 'switch' within UK.
c) since b is not possible c is also not possible. (gurus correct me if i am wrong)
d) not sure on this but after you change to T2G dependent you can work with new sponsor if offer still exists.

Please see this thread, where OP who is on T2 ICT dependent plans to move to T2G
