EU4FAM Resident Sufficient funds

HI Friends,


I am living with my spouse she stopped working few months ago, and she has been earning 900€ ( Combined loan + scholarship ) from Danish government. She living here but study by Internet..
I have a contract an Hourly rate contract till End of Year. average 2300€ / per mont. so we both earn (3200€) / month
A lawyer told me that if we earn more than 600€ a week and 2400€ a month we are not eligible for social welfare so we could switch to
EU4FAM Resident Sufficient funds ....

we have a comprehensive health care insurance as well
Do you think we could Eu treaty right office with this documents to prove our Income for 2014 and be ok for Resident Sufficient funds ?
