[Urgent] When am I not allowed to work?

Post by stayintheuk » Thu Mar 27, 2014 9:33 pm

Hi, I have an urgent question waiting for an accurate answer.

I was thinking of moving so I applied a new Tier 2 General visa with employer B when I am employed by A. But A asked me to stay and I am considering this seriously.

My trouble is the following. After I talk with B regarding changing my mind to stay with A, B will cancel my visa in the system. Then Home Office will make the decision to curtail my stay to be 60 days and notify me of this by mailing. But as far as I know, the Home Office may need 28 days for making this decision after they are notified by B of the visa cancelation. My question is when am I not allowed to work for A? From the moment that I am notified by Home Office of the curtailing or from the moment B cancels my visa (but how could I know when they are going to cancel visa?) or from the date right before the start date on B's certificate of sponsorship??

If you know the answer, could you please kindly cite any legal proof? Because A asks me to stop working right after I start talking with B about staying with A.. Then I have to be out of work for almost a month for waiting new visa with A done.. I'm very appreciated to your reply.

If you You can work for A until the start date on BRP of B.
If you've already received brp for B you can't start working for A until you make a change of application. You can then start working for A on start date of its brp

Thanks. I don't fully get you. Do you mean that under whatever circumstance I can continue working for A until the start date of B's visa? Even if B cancels my visa before the start date on B's visa and Home Office hasnt notified me yet of the 60 days curtailing?

Could you please find any official proof of that? Many thanks.

You can only work for one employer at a time! Whenever you change jobs, a new application and brp is required. The start date on your new job is as stated on the brp!
Forget about notifications by employer and cancelation by ukba etc and work with these principles.

But on my current B's visa, I can work for A until the start date on B's visa. Shouldn't this only be stopped until I get notified by Home Office of curtailing to 60 days?

Could you please kindly complete the first sentence in your reply? I have to find out what you wanted to say regarding the condition to work for A until the start date of B's visa. Many thanks.

I'm not sure what else you want to hear!
You can't eat your cake and have it. If you make a change of employment application, ukba will not curtail your previous leave, it's your responsibility to start your new job as started on your new brp!!!!
Your case is different from someone who looses their job and DOESN'T HAVE A NEW SPONSOR...it's in this case that ukba may write to curtail their leave to 60 days or 6 months depending on how much time is left on their visa.
You need to make up your mind which employer you want to work for. There's the possibility to be off work for a while during change of sponsors depending on how quickly your new application is processed and your current employers' understanding of the immigration rules.
Refer to tier 2 guidance, section under change of employment clearly states everything you may want to know.
