Refund of fee

Hi all

I got a specific question and scenario not found on other threads.

Me and my wife applied for HSMP in oct 2010.

Some law changed in Nov and our application was decided in Dec 2010 according to new law.

We appealed in immigration tribunal claiming that our application should have been considered according to laws in Oct 2010.

I was completing 10 year long residence as well soon and notified tribunal.

With home office accepted and agreed that they were unfair in dealing our application,tribunal allowed us to submit new docs regarding hsmp or submit a fresh application to vary my leave saying that previous application will be considered as undecided.

We obviously submitted a fresh application in july 2011 for ILR paying full fees,getting it in sept 2011.

I realized last year for first time that they should have refunded my fees of 850 paid in oct 2010. Claimed it to be refunded,got a reference no. from ukba complaints but after that never recieved any response from them since then.

Now my question for some kind and wise seniors, am i entitled for a refund or not?

If i am entitled for refund then under what laws or regulations?

As i already got reference no. what are other choices left to get my refund?

Where were u since sep 11 when u got your ILR.

After 2.5 years u remember that HO owe u some money.

I got no information about refund till by chance I heard in friends discussion about paying difference of fees and if you paid full then possibility of a refund.
