PSW dependant to Tier 4 general dependant, Institute not HEI

Hi

I am am here since 2005 and my wife and a child joined me in 2006 as student dependant. I was student till Sep 2011. Then I moved to PSW and my wife n child were on PSW dependant visa.
I was on PSW at last grant then applied for Tier 1 ent but later on varied my application to Tier 4 before any decision on Tier 1 application. My proposed course is level 7 and institute is HTS not HEI.
question is do my dependants qualify for dependant visa as they were here at PBS dependant visa ? or they fall for refusal because institute is not HEI ?

Any exclusions apply to this or its just a general rule for every one ?

I just spoke to a local solicitor and he said, this rule doesnt apply to those who were on PBS dependant before sep 2012
Is it correct ?

Hope you didn't pay for that advice. There are no exceptions once you switch out of tier 4 you can no longer rely on the wider provisions that allow dependents of students who are not studying at HEIs to qualify.
