Hi I need I need advice in here please I'm British citizen antrim working at moment I'm planing to stop work due to sickness and my wife she,s under 2 years spouse visa we planing to apply for ilr in October and she's full time mum for 10 months old baby the question if I stop working and claim binifet due to sickness will her application for ilr will be refused? Thanks for any advice.

visa stamped 18/09/12
visa collected 20/09/12

You cannot make a claim for Incapacity Benefit, rather it would be Employment and Support Allowance. You will not necessarily be refused, so far as, you can adequately maintain and accommodate yourselves.

Thanks amber for replying so you mean I can claim employment support allowance but not incapacity binifet and my wife ilr won't be refused? Thanks
