My friend is an asylum seeker. He arrived to the UK on the 4th of March 2014, claimed asylum on the 12th of March 2014 and his application is currently being processed. He claimed asylum on the basis that he fears persecution from by his family because of his sexual orientation ( he claimed that he is gay )
He met a girl on a dating application, and they are really getting along . they have been in a relationship for 2 weeks now . This girl has a dual citizenship, British and Maltese ( her mom is from Malta ). they are planning to get married if there relationship progressed more and more ( which as i see it will ).
I got several questions :
* will the fact that he claimed asylum as LGBT might effect him being married to a women ?
* can he actually get married ? cause his passport is with the HO but he has ARC issued from the HO that identifies him ( with photo of him on it )
* If he is able to get married to her ... will he be then been considered as an EEA family member ? or he will be considered as a spouse of a British citizen ? ( i mean to apply for a residency under EU law )
