Help please

Post by NK_2014 » Sat Apr 05, 2014 11:09 pm

Hi everyone,

I searched and searched for something related to this enquiry, but came up with nothing thus far...

I applied last month for naturalisation based on my ILR from 2010 that I received as a spouse of a BC. Shortly after I submitted the application, my husband asked me for a divorce - great timing, right? So here I am with the fee already debited from my account, but my marriage has dissolved and my application is still pending. Since I already had ILR, should my current marital situation have any bearing on my naturalisation application or subsequent passport application? If I receive an approval for naturalisation, I would ideally like to return to my home country and make my passport application there when I am ready, but I am worried that a divorce would adversely affect one or both of these applications. Has anyone else had experience with this? Any information would be much appreciated.

Many thanks,

NK

For naturalisation you're not divorced until you receive the decree absolute.

If you meet the requirements under 6(1) I.e. 5 years in the UK including last year with ILR then being divorced wouldn't matter. If you receive the decree absolute before a decision is made, you should write to the HO. It would have no bearing on a subsequent passport application.

Thank you very much. It's especially comforting to know that it should have no bearing on the passport application, though I think I will still wait until I have the passport in hand to ask for the decree absolute. Best wishes.

Divorce isn't relevant in a passport application. Amber is referring to the application for British Citizenship.
(Casa, not CR001)
Please don't send me PMs asking for immigration advice on posts that are on the open forum. If I haven't responded there, it's because I don't have the answer. I'm a moderator, not a legal professional.
