Visa Refusal on Salary Basis

Hi

I was on PSW visa which expired on 3rd March, 2014. I applied for work permit but I got refusal due to minimum salary, my company has agreed to increase salary and apply for new CoS. I have requested my documents back from Home Office to apply fresh application.

The only thing I want to know that my PSW expired on 3rd March, and I got my refusal letter on 20th March during my case. Now when I receive my documents and apply quickly again, is it ok? Will I be considered as an illegal as I don't hold visa and also withdrawn the previous application for visa as there is no need to appeal, this was our mistake and we need to file new visa with increased salary.

Please guide.

You have a grace period of 28 days before your next leave to remain is approved.
Apply in the priority route if possible.

Look up the immigration law section on UKBA / Home office website for more details.

Thanks for your reply.

I called the UKBA and they asked me not to apply for return of documents if I am applying another fresh application, so I just applied another application and mentioned that my documents are already with UKBA. Just wanted to know that is it confirmed that I had the grace period of 28 days because in my refusal letter, it was not written anywhere and when I received my refusal with right of appeal, my previous visa was already expired. I applied fresh application after expiry of my previous visa. Now I have given my biometrics again on 1st of April and waiting for decision now.

I am currently in the same situation.
Can you tell me what happened in the end and what would you advise me to do.
My visa was refused because of inappropriate salary and now I don't know what I should do.
