Qualifying Period for 18 years dependant child

Post by chalbury » Sat Apr 12, 2014 12:19 pm

I am currently on Tier 2 ICT Established Staff category visa valid since July 2010 till July 2015.My family ( Spouse ,Daughter & Son ) joined me in the UK in Feb 2012.I know that I cannot apply for ILR after 5 years stay on Tier 2 ICT since my Entry Clearance is after March 2010.I am looking at 10 years route for ILR since my current Tier 2ICT can be extended without limit till my employer wishes to.

Daughter - currently 14 years age
Son - currently 10 years age

My question is as below :

1) I will be eligible to apply for ILR in July 2020 in long 10 years legal resident route , can I apply for all my dependant's at the same time.?
2) If My son completes 7 years continuous stay in Feb 2019 can I use that route to apply for ILR ?
3) Most importantly my daughter will complete 18 years in Jan 2018 does that cause any problems , since I read on guidance that 18 years + will have to leave UK.
4) On the basis of my son getting ILR in Feb 2019 & me & my spouse getting ILR same time in Feb 2019 because of my son geting ILR however what about my daughter ? Since her total stay in the UK in Feb 2019 will be 8 years & she will not be eligible for ILR since she has not completed 10 years.
Can My daughter 18 years + old carry on DEPENDANT visa till she completes 10 years in Feb 2022 , after which even she can apply for ILR.

Can you please help.

You're asking far too early, lots could change in 6 years. However, under the current rules, having a child in the UK for 7 years is not a way to get ILR, it's a possible route to settlement which takes 10 years. It could be possibly used to get FLR.

Thanks Amber , I know its too early however need to plan accordingly.Whats the difference between ILR & FLR please.
And also the basic questions is hope my daughter turning 18+ will not be a show stopper & she can carry on a DEPENDANT visa with me.

Those over 18 may continue as deps so long as they do not live independent lives.

FLR = further leave to remain, ILR = settlement.

Dear Amber and respected Guru/member,
Thank you so much for helping so many here- I hope you can help me as well regarding my daughter (18+) visa.
I am on Tier-4 visa and my daughter is on Tier-4 dependant visa and she is now 18 year old. Both of us have our visa valid until Dec 2016. I will apply my ILR in July 2015 on the basis of long term residency and hopefully I will get ILR by the end of 2015. My daughter will complete 10 years in October 2016. I will appreciate for your answers/ guidance on following:
1) will my daughter (18+) current Tier-4 dependant visa be valid until Dec 2016 after my ILR in 2015?
2) After my ILR, if her visa become invalid, how she can get dependant visa after my ILR?
3) Do you think any benefit to postponed my ILR application until 2016 when she also complete 10 years, to avoid complication to her current visa as she is over 18?
Thanks
