EEA Family Permit

Hi,

My case is a bit complicated. I came in London under Tier 4 student category in 2009 and extended my visa in 2013. My second extension is due on Jan 2015.

The person with whom I am planning to get married is from Romania. She comes here 3/4 times a year as she is studying over there. But she will start living permanently from September this year. I would like to mention here she lived in London for more than 1 and half years before commencing her studies in Romania. But as I mentioned, she comes here often during her holidays.

I would like to know the following:

Will there be any difficulties when i will apply for EEA family permit visa i.e. spouse visa ?

Is FLR M the right form to fill for spouse visa?

I will have 3/4 months left on my visa when I will apply for spouse visa, will that be a problem?

Do I need to fill the section 7 Finance requirement even though my application will be in country application?

Is it must for my wife to earn at least £18600 even though I am in this country? If not, can I leave the finance requirement section empty in FLR M form?

I would highly appreciate if someone answers my queries please. Thanks in advance.

Once you are married and assuming you are living in the UK, apply for a 5 years Residence card using form EEA2.

What is the difference between FLR M form and EEA2 form? As my girl friend is not living in UK permanently now will EEA2 form will be a safe option to consider?

Thanks for your answer. What is the difference between between EEA2 and FLR M form? My girlfriend is not living in the UK permanently at the moment,she is coming on and off and staying for a month before leaving. But she will start leaving here from September. Do I have to apply at least 6 months prior to the end of my visa? Or can I still apply if I have 3/4 months of visa left?

FLR(M) is under the UK immigrations rules. EEA2 is under the EEEA Regulations. You can't use the UK immigration rules but could use the EU ones once she lives in the UK. You could only apply once you are married. It doesn't matter how much you would have left on your visa.
