Overstaying on a family visitor's visa - any grace period?

Post by foreverhopeful » Thu Apr 03, 2014 10:17 am

My mother's 6 month period expires soon and I wonder about the consequences if she overstays by a few weeks. There is some unfinished business that she needs to attend to and she would rather not go home and then return to finish it.
Is an overstay simply an overstay whether by one day or one year, and if she does overstay by a few weeks is this likely to prejudice any future applications to visit?

Not business in commercial sense - she is retired and some family matters need sorting while she is here.

Any overstay is unlawful and something that she will have to declare whenever she applies for a UK visa in the future. It may mean she is less likely to be issued a visit visa in the future. Is the family matter worth this risk?

hi

Be prepared for visa refusal with ban when she apply again.

the magic number is 90 days

she is still an overstayer after day1, but it has to be 90 days overstay to trigger a ban, eg general grounds of refusal

If you have overstayed by 90 days or less and left the United Kingdom voluntarily at your own expense then there is no general ban.

See chapter 62 (click).
