Reconsideration Request

Hello forum!!! Nowadays does home office consider reconsideration request for human right application (refusal of7 year child application) ? Solicitors saying home office stop considering reconsideration request from nov 2012. Please comments on this. I sent my reconsideration request on sept 2013 after refusal my 7 year child application, till now no answer from them. Even sent further letter(enclosed photocopy of my child british citizenship) on feb 4, 2014 my circumstances are changed (my child got a british citizenship) to urge the home office grant our stay but no reply yet. Does this kind of letter consider the home office? Again 11th april 2014 sent another letter.

your solicitor is right, although not entirely -- they havent completely stopped, but list of reasons for reconsideration is limited.

this mainly realtes to situations if HO failed to consider a document or documents that it had received prior to decision date, if application date is contested, and you can show that a document they thought false is genuine:

The Home Office will therefore only reconsider applications, if:
 The reconsideration request was made on or after 13 November 2012, it relates to an application that was granted, and the applicant believes the type of leave granted or the expiry date of the leave is incorrect.
 The reconsideration request was made on or after 13 November 2012, it relates to an application that was refused and the applicant is either:
o providing new evidence to prove the date of application
o providing new evidence that documents submitted with the application are genuine, or
o identifying relevant material which was not available to the caseworker but was received by the Home Office before the decision date.

@ Shondra Sharma, HO usually consider reconsideration request but they seem to ignore some. Since your situation has now change why don't you discuss with your solicitor if you can submit a fresh application under parent of British child.

What route did you apply initially and which form did you use?

Hi thanks for response. Initially I used flr(0) form under 7 year child application in sept 2012 and got refused in aug 2013. My solicitor sent a reconsideration request in sept 2013 and sent another letter in feb 2014 when my child got a british citizenship. My solicitor saying there is no need to reapply, this letters works but when? fed up with this limbo life. Its already 3 months my child got a british citizenship.

Not been in uk for 20 years and at the time of application no valid leave, overstayers, no british citizen, child have a best interest with their parents, even application time my child was nearly 9 years old and born here in uk.
