ILR & Passport expiry

Hi,

I got my ILR stamped on my passport this month. MY passport is expirying in december.

Obviously I'll be getting a new passport from the local Highcomission(India) office.

My Q is
a) Is it mandatory to trasfer the ILR sticker on to my new passport thru HOME office ?
b) If YES, where can i read the official statement or wording ?

My worry is the £££££££££ which I'll be spending to transfer the ILR sticker ?

It is not a necessity for the ILR to be transfered to your new passport. According to the BIA website, the instructions for the form to use incase you do intend to transfer the stamp, NTLTOC, it says:-
For your information, you can travel with a new valid passport without having your leave transferred from the previous passport, provided that you carry your old passport with the endorsement of leave, or the letter in which your leave was granted

For your information, you can travel with a new valid passport without having your leave transferred from the previous passport, provided that you carry your old passport with the endorsement of leave, or the letter in which your leave was granted.

It is up to individuals to ensure their travel documents are kept up to date and are valid for travel. The decision to admit a person at port is made by the immigration officer based on the information and evidence presented to them.

i have a case

is it possible to apply for the letter and not for the stamp in your passport when you apply for indefinate leave?

as their is a person who holds a malaysian passort and it expries every 5 years and they do not retun your passport back

effectively bringing more costs and more hassle

i wait for your queries

The Home Office do not supply a letter for indefinite leave to remain unless you are a refugee or stateless person who is unable to obtain a passport. The only official documentation you will receive proving that you have indefinite leave to remain will be a visa sticker in your passport.

I can't, however, believe that the Malaysian government does not give people their expired passports back. Even if they didn't, this person could always lie and say he lost his passport and then request a new one. The authorities can't then expect him to give it back if he's "lost" it.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.
