Traveling back to UK on tier4 visa after 6-months

Post by munna1suk » Sat Apr 19, 2014 1:28 pm

Hi All,
I am an international student (have already completed MSc from one of the UK university in 2012) was studying second degree from one of the college in London, I returned to my home country on 3rd Oct 2013 because of illness of my father, I have been taking medical treatment of my father here in my home country (Pakistan) since last 6 months. However, now I am in a position to return back to the country (UK) in order to resume my studies as I have still got BRP (Visa) till 31 August of this year but the college responded me that they have reported me to ukba for not attending the college since long. Whereas, I had already told them the whole story but they still reported me to ukba without giving me any formal notice. Neither I have received any notice from ukba yet.

I do not know exactly whether or not ukba has curtailed/cancelled my visa as they do not cancel so quickly, therefore I am looking forward if any one can help me out with the following:

1) Is it safe to travel back to the country in this scenario on the same visa to resume my studies, If I show medical record of my father on airport?
2) If refused entry, do they mark any thing to my passport or does it impact on my immigration history?
3) Is there any way of appeal if I get refused?
4) how to confirm whether or not my visa has been curtailed/cancelled or college has literally reported me before I travel?

please help me out with this I will remain very thankful to you.

Regards

@ munna1suk,

1) Is it safe to travel back to the country in this scenario on the same visa to resume my studies, If I show medical record of my father on airport?

Ans: Your visa is most likely to have been curtailed, so trying to come into the country will only lead to deportation and more problem for you.

2) If refused entry, do they mark any thing to my passport or does it impact on my immigration history?

Ans: Definitely yes, you are trying to get into UK when you could have easily confirmed your visa status with a simple phone call to HO from your home country. They will see that as deliberate deception to gain entry when you know that your visa is likely to have been revoked.

3) Is there any way of appeal if I get refused?

Ans: Why will you want to appeal a revocation that was made solely on the fact that you breach your visa condition by not attending college and also making no effort to defer your course by simply writing a letter to your college and then following it up to confirm that they can defer your programme till when your father get better.

4) how to confirm whether or not my visa has been curtailed/cancelled or college has literally reported me before I travel?

Ans: Make a simple phone call to HO from your home country and also send then an email so as to get an answer on record for future application.

Thanks a lot Olasunkanmi for such a nice response. I further need to know if I do not call to HO and leave my immigration status as it is and forget to travell back to UK, does it still impact badly on my immigration record for future applications as college has reported me to ukba?

please guide me further

thanks

@ munna1suk, you should not have any problem if you decide to apply in the future rather than coming to UK now that your visa is likely to have been revoked.

College reporting you to HO is a standard procedure which is required by all schools to follow if a student do not attend class for a specified period. In your own case, the implication of college reporting you would have been that HO will have your visa revoked and then expect you to leave the UK and you have already done that even before college reported you.

So in my own opinion, you should be fine in any future application because you did not go against any UK law.
