Non EEA living with EEA national spouse in UK on residence card..... is it possible after completion of 5 year residency period , he goes to Spouse country of birth and claim citizenship without having lived there for 5 years ? how would it be possible ? Let say my spouse is Polish national. I am non EEa 3rd country national. after completion of 5 years residency can I go and claim citizenship of Poland ??

Please guide.

We do not know your spouses citizenship, in most countries in the EU, there will always be some sort of residency requirement.

She is Latvian. There should be some way to get citizenship as are residing in member eea state uk ?

Thanks. And as general question , is there any such country that offers citizenship to spouses of their citizens without fulfilling residency requirements in that country Or on grounds of short term residence like just one year ?

AFAIK, in the EU, there isn't such country, the Netherlands used to have the practise, there was a proposal probably last year or a year before to halt it.

I think Spain grants the right to apply for citizenship to spouses of Spanish nationals after 2 years of residence (I think). For Ireland it's 3 years.

Don't think there are any EU countries that still offer automatic citizenship by marriage, but I remember someone said that Moldova does this.

Anyway, as you can't choose your current spouses citizenship so this is a pointless question. Either go and live there or live somewhere else in the EU and try to get citizenship there. This is possible.

I will wait for Scotland to declare independence and be part of EU . Closest to me I would move there and transfer job too and get Scottish European citizenship

Why not just have your spouse continue to exercise treaty rights in the UK and apply for citizenship after 6 yrs there?

I initially wrote Latvia In-terior ministry website, surprised that the website has automatically replaced it for rubbish ministry, interior doesn't appear as an offensive word to me.

As she has automatically acquired PR status if she get confirmation vignette will it mean is no longer required to be exercising treaty rights ? If we don't apply for pr resisence I will have to prove her status when I apply for pr residence after 3 years ?!

Yes; if she already has achieved PR status after having exercised treaty rights for 5 years then she doesn't need to be exercising them anymore. You could get her EEA3 to prove this. That would definitely make things easier to prove when it comes to applying for your own PR in another 3 years, as, otherwise, you will have to show how she achieved PR (you would need to put together a bundle of documents to show this).

I assume you say 3 years because you have already been in the UK with her for 2 years? Is that right?

Hi thanks. Yes thats right I am having liberty of being her spouse for more than 2 years. She has got pile of all payslips, p60 etc etc living at one address. ... case is bit easy. I shall get all copied and throw one payslip for every month for 8 years to HO so we won't give them a f.....* to refuse her PR. Game on !

Yes dear we EEA migrant workers will kick their balls very hard piles of bank statements, payslips, utility bills , permanent contract with most famous multi national employer , ....
