Hi to everyone and thanks for reading my post! I posted some topic long time back when i needed some information and was more than happy with the response from the members, it did help me very much to find the right solution for my problem at that time.Returning here for a friend of mine who needs some good advice.Well ,we visited a few leading immigration solicitors today here in London and where given some quite contradictory informations and i'm here guys for your help again!
Indian origin
Came to the Uk in June 2006 on the student visa (2006-2008 ) ( 2 years)
Applied for another 2 years but was rejected and given a right to appeal ,but withdrawn before hearing ,and made another fresh application for the students visa which was successful (another 2 years) (2008-2010)
2010 applied for the POST STUDY VISA and got it for 2 years ( 2010-2012)
In May 2012 (7 months remaining on current Works study visa) got 2 job offers for Sponsorship visa.
Shoosed the company (Big Food chain business,A license holder listed on UkBA site ) that believed will be best for his professional progress but in October 2012 when the time for visa was to apply ,the company said that they can't help,and they can sponsor only HR staff(he is HR manager by graduation but manager of one of the food brunches)
According to me, company either have or don't have the license is not according to position as he satisfy other requirements of salary and that job was advertised before on the job market)
He has got apology letter from the company that they had made mistake but that doesn't help much
As he didn't have much time to think the only option was to apply for FLRO
His parents live in the Uk(mum Uk National,Dad ILR,sister ILR but live up north and he is in LOndon,but visiting on monthly basis to help mother looking after his ill dad,no ties anymore with country of origin since arrived in the Uk (June 2006) only 2 short visits for those 8 years
AFter a year application was rejected and he appealed and the court hearing was last week .Appeal was based on the family grounds we just realized weak link as they live in different cities but that was what solicitor recommended .After the hearing,the Judge told me that most likely decision wont be made in my favor .
Looking fro options what to do next
His aim is 10 years long residency
but 1 solicitor told today if he made another fresh application he will have break in the continuous residency? Probably better would be fresh application that waiting for the court decision)
SO FAR THAT IS 7 YEARS AND 11 MONTHS LAWFULLY IN THE UK
HE ALSO MENTIONED HE CAN'T GO AND STUDY FOR THOSE REMAINING 2 YEARS AS THE TIME ON STUDENT VISA IS LIMITED TO 5 YEARS
