Experts please advise tier 1 or asylum?

Hi all
I'm on PSW and living in uk since last 5 and half years. My wife joined me last year. Anyway my all family is living in uk. They claimed asylum and it was approved in 2013 (after 3 months). Long story short, I applied for tier 1 entrepreneur at the the start of April and received biometrics after 2 weeks. Now after reading too many refusals I decided to not carry on my tier 1 application.
Please advise that shall I go for asylum or apply for student visa which is most convenient option at the moment.
If I claim asylum then I will fall in 10 years long residency?
Some well reputed lawyer also recommended asylum to me because we still have same problem back home. I need some more opinions.

Just spoke to another lawyer. He was our family lawyer as well and he advised me to go for asylum.

if you have family they been granted 5 years refugee and you have problem go back to your country I Suggest go for asylum
if you been granted 5 years refugee then you can apply for ILR after 5 years

If your family qualified for refugee status doesnt mean you will get the same status.Each application is different and they could decide you dont qualify for refugee status.

If you can meet the requirements of tier 1 i would go for it. If you claim asylum there is a risk of detention while they process your application and there is even bigger risk of getting your asylum application fast tracked whilst in detention.

My mother and brother has been granted refugee status in 2013 and my wife arrived in 2013 as well. I went there only for 2 weeks.
I also want to stay on tier 1 but after reading a lot of stupid refusalS and have seen people spending a lot of money on their appeals I decided to go for asylum.

detention only for people overstay if someone claim asylum before there visa expired they will get accommodation if they don't have

They normally detain the singles and it's not a condition that they detain only overstayers. I have seen many people who had valid visas and they were detained. But it normally don't apply on families.
I need to be get rid from this confusion asap.

my brother he claim asylum last years and he wasn't have any accommodation and he apply before he's visa expired one week and the help him with accommodation without send him to detention

My advise to u is keep this asylum card in your hand till last.

More time u spend here legally will count in your favor. U can claim asylum at anytime. There is no hard and fast rule.

After consulting many solicitors now I'm gonna take asylum option which is a bit convenient for me.
