Leaving once overstayed????

Post by octo » Wed Jul 18, 2007 10:43 pm

My fiancee entered the US on a visa 14 years ago, but didn't return when it expired. He has lived there since.

I live in the UK and we plan to return to his country to apply for a visa for him to settle here with me in the uk.

1. What can we expect to happen when we leave the US with him having overstayed? Will he be allowed to just leave? ( I know he will have a 10 year ban )

2. How will this affect him obtaining a visa to the UK? Is it likely to be denied because of this?

Thanks in advance

The UK won't deny him a visa, as long as he meets the requirements. I am not 100% sure on one thing - do the visa applications have any questions about overstaying in another country? I mean...he has been in the US for so long he will obviously have to give information about his time in the US, but I don't know whether or not they will ask information about his immigration history there. But, at least, be prepared for that.

How did you meet? (or, even, have you met?) Someone else can help you with what will happen when he tries to leave the US, as I don't know. You are applying for a fiancee visa - just a note that he cannot work on that visa so you need to make sure you don't wait too long, otherwise he'll get used to lazying around!

Thanks for your help Sakura.

Yes we've met!!! ( many many times!) We met when I went on holiday to the US. It was the last thing I was expecting, but they do say these things happen when you least expect them!!

I'm aware that he can't work on the fiancee visa ( unfortunately!) but I'm sure that I can find him something to do whilst I'm out at work!!!!

He shouldn't have any problems leaving.
