Can I do another master's degree and then PhD???

Hello all gurus and experts! I have three questions with regards to T4 student visa. Thank you very very much in advance for your answers

My main aim is to do a PhD in Islamic Finance and Banking. I have completed MBA in 2011 in the UK, and Bachelor of Science in Computing & Information Systems in Bangladesh before coming here. As I don't have any expertise in Islamic Finance and Banking, I would like to do a master degree in this subject before doing the PhD. So, since I have already spent 3 years 1 month at postgraduate level, my question is-

Q1. Am I eligible to do a master's degree now and then PhD? (I am guessing a master's degree would take around 12 to 15 months to complete).

My details are as follows-
15 Feb 2008 to 31 Oct 2009 - MSc (Master of Science in Digital Communications Networks) but did not finish.
26 Jan 2010 to 28 Jun 2011 - I have completed MBA (Master of Business Administration in Human Resource Management).
25 Jul 2011 to 25 Jul 2013 - PSW visa (Post Study Work).
5 Jul 2013 - Applied for T1 Entrepreneur route but got refused and subsequently appealed. I have attended the hearing today and now waiting for the outcome.

Q2. Am I allowed to switch back to student visa if my T1 entrepreneur application appeal get refused? And If I am allowed to switch back then-

Q3. If I apply for a student visa today then is it true that the course has to start within 28 days (from the application date)?

I really need this information as soon as possible to apply for a student visa if my current T1 entrepreneur visa appeal gets rejected. So, your expert advices and thoughts are highly appreciated.

Provding you do have at least 15 months and you get aceppted for Masters then I dont see why you cannot do do this in regards to PHD again depending if you get accepted to would need to be HEI institute.

Im not to sure on the rules of going through appeal on T1 and getting CAS for T4 perhaps the institutes you are applying for can give you this information they woukd know if they can or cannot proceed. Before paying fees I would wait until you get confirmation from where you want to study 1st im sure thier compliance team can help you find an answer.

Depending in the outcome of your appeal or if they give you a time limit to look for a course all depends. 28 days rule is when ur VISA is expiring then you would have to start a course within 28 days. You would need to show higher maintenance which is 9000 and I think it goes up in july to 9180.

Three more clarifications if you could-

1. Is PhD not included in the 5 years (degree level) cap?
2. If my appeal gets refused next month (May), can I apply for a master's degree starting in September?
3. I am asking this question because I've seen somewhere that I need to show my progression in my studies. Also, I am under the impression that an MBA degree is somehow superior to a master's degree. So, is this going to be a problem to get the visa for a master's degree given that I have already completed an MBA degree?

True phd is nt counted towards the limit

If you get refusal in May ukvi woukd give you a time frame to stay in uk where you can look for another institute or leave uk. I dont know if ukvi would give you enough time till september best to see the letter they issue you at the end of the appeal as it will give yiu more detailed information. Also speak to the visa officers at the institute yku are going to apply for.

Your progression could be complementary just depends on what you write on your personal statement when submitting your application and if you get accepted how the institute word this on your cas letter. Whoever you are doing your masters with will know all this and will know not to issue cas if they can't as a refusal would also leave a mark on the institute.
