housing benefits?

Post by Whocares » Sat Apr 26, 2014 12:30 pm

I am married to an Eu national for 5 and a half years. We are seperated at the moment and he went back to Spain. I have been in UK for 9 years. I came here on a student visa, then got a EEA2. Problem is that I don't have a job at the moment. I was working as a carer for 7 years and the patient passed away, so i lost my job.

Problem is, I am not entitled to jsa because I havent worked the whole of last 12 months. I don't have a job since last february. I had to move out and currently living in hostels.

My residence card expires in October this year. So what are my options? I am a bit desperate at the moment as I cannot find a job :(

Do you have proof that the EEA national was exercising treaty rights in the UK for the 5 year period you were married?

If you're not entitled to contribution based JSA then why not income based JSA?

Do you have children?

What proof of the EEA national exercising treaty rights do you have, what was s(he) doing during the 5 year period?

Ring his employer and ask them to send his P60s just say you're his wife and they're needed and for them to send the p60s to the home address, your address.

If you've been married to an EEA national who exercised treaty rights for 5 years in the UK whilst married, you have attained PR, in such case the CAB are wrong as you have the right to reside and claim benefits.
