Tier 2 (General) extension: salary information

Hi All,

I am currently on a Tier 2 General visa. I switched from PSW visa so was eligible for New Starter salary rate mentioned in Codes of Practice. The salary for me role is: New Starter - 25K, Experienced - 40K. My current salary is 28K.

My questions are:

1) Do I need to have 40K salary to extend my Tier 2 General in future or my current 28K (or maybe a bit more because of potential pay rise) will still be enough?
2) Looking forward, do I need to have 40K to apply for ILR in future or or my current 28K (or maybe a bit more because of potential pay rise) will still be enough?

you will need to be paid the experienced rate unless you are under 26 and not extending beyond 3 years total stay under T2G

2) Looking forward, do I need to have 40K to apply for ILR in future or or my current 28K (or maybe a bit more because of potential pay rise) will still be enough?
you will need to be paid at least the min rate for your SOC code or the min. specified by the HO at the time of your application (£35k after April 2016, rising in later years) whichever the higher.

Two more questions please:

1) Will I be able to change my SOC after 3 years in the same company for the same role and continue my work with different SOC that has lower pay rate (obviusly, my company will need to undertake a resident labour market test in this case)?
2) This is for a friend of mine: he will qualify for ILR in 2017 because he will reach 10 years' legal living requirement on that time . Does he also need to have 35K salary or in his case he doesn't need to show any salary? Thanks a lot!

It is not you but the company who is responsible for determining the appropriate SOC code. If your role didn't change but the company changed the SOC code they would be in breach of their duties and could be penalised by the HO
