Dear all,

Please can you offer advice on the situation? Apologies as it involves a bit of story.

I was in Tier 1 PSW and my wife was in Tier 4 General student when we got married [in UK] in May 2013. She received her Tier 1 PSW dependent visa in June 2013. She got an offer while on Tier 1 PSW Dependent visa from an sponsoring employer and started her job from December 2013. Because she went to her home country to get her Tier 2 General visa, I was not able to apply with her as her dependent at the same time. I was planning to apply from within UK as her dependent when she comes back to UK.

But in November I received an offer from a sponsoring employer too and and was offered Tier 2. I got a starting date in December as well and my in-country visa was actually sorted before my wife's out-country being done. Also my employer did not like the idea of me becoming her dependent and work.

So we both have Tier 2. Now, I am thinking what happens if one of us gets redundant in future or decides to quit to get a better opportunity to work for an employer who is unable to offer sponsorship. I understand that in my case, one can always switch to become dependent but what happens to the ILR clock? say for example, after 3 years, my wife (or me!!) gets redundant. Then she will be added to my Tier 2 as a dependent. If all goes well I shall apply for my ILR on November 2018, but will she be able to apply for ILR with me at the same time? if not, what will be her options and when she will be able to apply for ILR, please? her imaginary timeline in UK will look like this [please keep in mind we got married in May 2013 in UK as stated above]

December 2011 - May 2013 Tier 4 General student
July 2013 - Jan 2014 -- Tier 1 PSW Dependent
December 2013 - December 2016 -- Tier 2 General Main Applicant
December 2016 - November 2018 -- Tier 2 General dependent
